Reporting Instances of Copyright Infringement
The Digital Millennium Copyright Act of 1998 (“DMCA”) is followed by Lex Protector (Lex Protector LLP) in responding to reports of alleged copyright infringement. Additionally, if someone is identified by us as a “repeat infringer,” we will immediately and without notice terminate their accounts.
If you are a copyright owner or an agent of one and you believe that any content hosted on our website (www.lexprotector.com) violates your copyrights, you may file a notification under the Digital Millennium Copyright Act (“DMCA”) by sending the designated copyright agent of Lex Protector the following information in writing (please consult your attorney or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- The physical or digital signature of a representative with the authority to act on behalf of the owner of the purportedly infringing exclusive right.
- A synopsis of the allegedly infringed copyrighted work or, in the case of multiple copyrighted works on the Lex Protector’s website, a representative list of those works on the Lex Protector’s website.
- A specific identification of the allegedly unlawful or the subject of unlawful behaviour material that needs to be taken down or access to which needs to be restricted, along with information that is reasonably sufficient to allow Lex Protector to find the material. The best way to assist us in finding content quickly is to include URLs to the allegedly infringing content in an email.
- Information that would allow Lex Protector to properly attempt to contact the complaining party, such as the complaining party’s address, phone number, and if accessible, email address.
- A declaration that the complaining party has a good faith perception that the copyright owner, its agent, or the law does not permit use of the work in the manner complained of.
- A declaration that the details in the notification are true and, under penalty of perjury, that the complaining party has the right to speak on behalf of the owner of the allegedly violated exclusive right.
Please be aware that anybody who willfully misrepresents that content or activity is infringing may be held liable under Section 512(f) of the DMCA.
Submitting a DMCA Counter-Notification
If you choose to send us a counter notice, it must be in writing and contain the information listed below in order to have it be valid (for more information, please refer to 17 U.S.C. Section 512(g)(3)).
- The user’s physical or digital signature.
- A description of the content that has been deleted or to which access has been restricted, together with the URL of the page where the content existed earlier.
- A declaration made under oath that the subscriber has a good faith belief that the material was taken down or disabled due to an error or misidentification of the content that was intended to be taken down or disabled.
- The user’s name, address, and contact information, along with a declaration that the user consents to the jurisdiction of the Bhubaneswar District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the State of Odisha, India, for any judicial district in which Lex Protector’s may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person, and that the user.
Please be aware that anybody who willfully makes a false statement claiming content or activity was removed or disabled due to an error or misidentification may be held liable under Section 512(f) of the Copyright Act.
